Relating to consideration for exemption from penalties for administrative violations due to effects of Covid-19 the General Department of Vietnam Customs requests to base on the regulations at clause 3 Article 8 of Decree No. 118/2021/ND-CP and guidelines at Official letter No. 4428/TCHQ-PC dated September 15th, 2021, Official letter No. 54/TCHQ-PC dated January 7th, 2022 and actual cases to settle.
According to the regulations at clause 3 Article 8 of Decree No. 118/2021/ND-CP, in case the authorities verify and collect full information, data, documents to clarify that epidemic is the direct cause of administrative violations; if violators are not able to anticipate disease circumstance and overcome although they took all necessary measures within their abilities, regulations at clause 4 Article 11 of the Law on Handling of Administrative Violations may be applied to avoid administrative penalties.
