Official letter No. 5110/BXD-KTXD dated November 11th, 2022 of the Ministry of Construction regarding guidelines on adjustment to time of construction contract performance

According to the regulations at clause 1 Article 14 of Decree No. 37/2015/ND-CP , time of construction contract performance is counted from the effective date of the contract till the parties have fulfilled their obligations under the signed contract.

The effective date of a contract is the date when it has been signed (affixed with stamp if any) or other specific times as agreed in the contract and the employer has received performance bond issued by the contractor (for a contract with provisions on performance bond being specified) (Article 6 of Decree No. 37/2015/ND-CP ).

The adjustment to a construction contract shall be carried out according to the contents of the signed contract in line with invitation documents, bidding document and regulations of laws provided for contracts.
