Official letter No. 3799/BXD-KTXD dated August 22nd, 2023 of the Ministry of Construction regarding handing a case where a contractor of a partnership that is performing a construction contract wishes to withdraw from a partnership

According to opinions of the Ministry of Construction, in case a contractor wishes to withdraw from a partnership in the course of performance a construction contract, the project management board will base on contents of the signed contract, partnership agreement, other related contract documents, contract performance practice to decide plan for organizing the construction based on reference and application of regulations on handling of bidding cases as prescribed at Article 117 of Decree No. 63/2014 /ND-CP, regulations on sub-contractor contracts as prescribed at clause 2, Article 47 of Decree No. 37/2015/ND-CP or regulations of related laws to ensure safety, progress and investment efficiency of the project, with proper operating capacity and compliance with regulations.
