Official letter No. 5014/BXD-QLN dated November 7th, 2022 of the Ministry of Construction regarding guidelines on number of apartments foreign organizations, individuals may own in a housing construction project

The Ministry of Construction assumes that laws on housing do not regulate the number of houses each foreign entity may own in a housing project.

Article 161 of 2014 Law on Housing and clauses 2, 3, 4 Article 76 of Decree No. 99/2015/ND-CPstatus2 only regulate the total number of houses (apartments, detached houses) foreign entities (one or many organizations, individuals) may own in a project. To be specific, it must not exceed 30% of the number of apartments of each apartment building and must not exceed 10% of the total number of apartments in a project.
