Official letter No. 2095/BCT-KHTC dated April 11th, 2023 of the Ministry of Industry and Trade regarding guidelines on performance of activities of trade intermediate and trader's representative

According to opinions of the Ministry of Industry and Trade, in case a foreign direct investment (FDI) enterprise is granted the business license to perform activities of trade intermediate and trader’s representative to distribute goods in Vietnam, in principle the FDI enterprise may conduct these activities in line with its business license and regulations of the Law on Commerce regarding “trader” and “foreign trader”.

In case the FDI enterprise wishes to perform activities of trade intermediate and trader's representative with contents/ entities different from the regulations at the business license, it is required to carry out procedures for adjustments to the business license in accordance with Decree No. 09/2018/ND-CP .
