Relating to land use forms in order for investors to act as owners of commercial housing construction projects, at clause 5 Article 1 of Decree No. 30/2021/ND-CP regulates these cases:
(1) Having lawful residential land use rights;
(2) Having lawful rights to use residential land and other types of land permitted by the competent authority to be repurposed into residential land;
(3) Receiving transfer of residential land use rights according to regulations of law on land for commercial housing construction.
From March 1st, 2022, Law No. 03/2022/QH15 (amending a number of articles of the Law on Public Investment, the Law Public-Private Partnership Investment, the Law on Investment, the Law on Housing, etc.) amends forms of land use eligible to execute commercial housing construction projects as follows:
(a) Obtaining the right to use residential land
(b) Obtaining the right to use residential land and other types of land other than residential land that meet requirements for change in purpose of land use for execution of the projects.
