blue-check New policies for redundant employees

This Decree is to promulgate new policies for redundant employees upon rearrangement of wholly state-owned enterprises under the following forms:

1. Equitization or selling of entire enterprise.

2. Conversion into a multi-member limited liability company.

3. Conversion into an administrative unit.

4. Merger, consolidation, split-up and split-off.

5. Dissolution and bankruptcy.

Accordingly, redundant employees (they have to quit their jobs because enterprises cannot assign works) that have been recruited before April 21, 1998 or before April 26, 2002 shall be entitled to the retirement and allowance policies prescribed at Article 3.

For redundant employees who have been recruited from April 21, 1998 onwards or from April 26, 2002 onwards, they shall be entitled to the policies for redundancy allowance, severance allowance prescribed at Article 4.

This Decree takes effect from January 15, 2023.

To replace Decree No. 63/2015/ND-CPstatus1 dated July 22, 2015; Circular No. 44/2015/TT-BLDTBXH dated October 22, 2015; clause 3 Article 40 of Decree No. 46/2021/ND-CP dated March 31st, 2021.
