This Official letter is to give opinions about the establishment of a foreign direct investment (FDI) enterprise in the domain of building cleaning services.
According to the Ministry of Planning and Investment’s opinions “Building cleaning services” are not regulated in the Schedule of Specific Commitments in Services of Vietnam in the WTO - in other words, Vietnam has not yet made commitments on foreign investors’ operation in this domain.
However, this domain does not belong to business lines banned from business investment in Vietnam (Article 6 of the Law on Investment No. 67/2014/QH13 ).
On the other hand, if a foreign investor is a juridical person established in Japan, his/her investment may be considered being accepted under the Agreement between Vietnam and Japan for the Liberalization, Promotion and Protection of Investment (BIT-2003) and the Agreement between Vietnam and Japan for an Economic Partnership (EPA-2008) because the aforesaid domain does not belong to exceptional sectors.
