According to opinions of the Ministry of Construction, the Law on Real Estate Trading No. 66/2014/QH13status2 only regulates scope of real estate trading, cases eligible to purchase, receive, rent, or lease purchase real estate of foreign-invested enterprise (FDI enterprise); there is not regulation on how to determine FDI enterprise.

The determination of FDI enterprise belongs to the scope of adjustment of the Law on Enterprise and the Law on Investment.
